1. Service Provider

The Playbook Society, hereinafter referred to as "TPShip" or "Provider", operates the TPShip platform, accessible at ship.theplaybooksociety.com, designed for real estate professionals.

2. Subject Matter and Acceptance

These Terms and Conditions govern access to and use of the TPShip platform, an AI-assisted service for creating real estate marketing materials.

By completing registration and/or payment, the user fully accepts these Terms. If you do not agree with any of the conditions set out herein, you should refrain from using the service.

3. Service Description

TPShip provides a platform that enables users to generate real estate communication materials (landing pages, visit sheets, reports, social media content, and other formats) based on content entered by the user.

The service operates on a BYOK (Bring Your Own Key) model: the user utilises their own Anthropic API key, paying Anthropic directly for AI processing costs. TPShip does not invoice API costs or act as an intermediary in that relationship.

TPShip does not warrant that the materials generated are suitable for any specific purpose, nor does it accept responsibility for the accuracy or completeness of AI-generated content.

4. Subscription and Payment

Access to the platform is subject to payment of an annual subscription of €97.00 (ninety-seven euros), exclusive of applicable taxes.

Free trial period: The subscription includes a 7 (seven) day free trial during which the user has full access to the service at no cost. No charge is made at the time of registration. Upon expiry of the trial period, the annual fee of €97.00 is automatically charged, unless the subscription is cancelled before the trial ends.

Payment is processed securely through Stripe. The user authorises automatic annual billing, and may cancel at any time through their account area, effective at the end of the current billing period.

Billing is for the full annual term and is not pro-rated. Save for the 14-day reflection period described in Section 5, access remains active until the end of the contracted annual period and no partial refund is due for early cancellation.

5. Cancellation and Refund Policy

Users may cancel their subscription at any time from within their account area. Cancellation takes effect at the end of the current annual billing period; access to the platform is maintained until that date.

A full refund is available if requested within 14 (fourteen) days of registration (the date on which the user signs up and registers their payment card) — the statutory reflection (withdrawal) period. Provided the service has not been materially used during that period, the refund is granted in full. Where the user has actively used the service within the reflection period, a pro-rata deduction corresponding to the period of use will apply.

After 14 days, or following material use of the service within that period, subscriptions are non-refundable. No refund will be issued for non-use, change of activity, or dissatisfaction with AI-generated content.

Any payment dispute (chargeback) initiated with a financial institution without prior attempt to resolve the matter with the Provider will be treated as a breach of contract. The user may face immediate suspension of access and potential legal action to recover the disputed amount and associated costs.

6. Intellectual Property

Materials generated by the user through the platform, once exported or downloaded, are the exclusive property of the user.

The TPShip platform, including its code, interface, prompts, and systems, is the exclusive property of the Provider and may not be reproduced, copied, modified, or distributed without express written authorisation.

The user agrees not to use the service for any illegal, defamatory, or third-party rights-infringing purposes.

7. Liability

TPShip provides the service on an "as-is" basis, without guarantees of uninterrupted availability or freedom from errors. The Provider accepts no liability for data loss, service interruptions caused by third parties (including Anthropic, Clerk, or Stripe), or for commercial decisions made based on materials generated by the platform.

The Provider's total liability, under any circumstances, shall not exceed the amount paid by the user in the 12 months preceding the event giving rise to liability.

8. Suspension and Termination

The Provider reserves the right to suspend or terminate the user's access in the event of: (i) breach of these Terms; (ii) abusive or fraudulent use of the service; (iii) initiation of an unfounded payment dispute.

The user may cancel the subscription at any time through their account area. Access remains active until the end of the paid annual period.

9. Changes to Terms

The Provider may update these Terms at any time, notifying the user by email with at least 30 days' advance notice. Continued use of the service after the effective date of any changes constitutes acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms are governed by Portuguese law. For dispute resolution, the parties elect the courts of Lisbon, waiving any other jurisdiction.

For alternative dispute resolution, users may also have recourse to the European online dispute resolution platform available at ec.europa.eu/consumers/odr.
